Basics of the Administrative Separation Process

An administrative separation is a process where a military department desires to “fire” or relieve a service member from their position.

Reasons for the administrative separation can stem from the following and more:

  • Minor misconduct violations
  • Unsatisfactory performance
  • Illegal drug use
  • Alcohol abuse
  • Physical and mental problems
  • Insubordination
  • Failure to adapt to military life

When referred for administrative separation, the service member is first notified of their intent to discharge the member, citing the specific reasons for the discharge. Known as notification processing ,the service member can contact an attorney and contest the discharge all by paper.

The second process is known as board processing and is entitled to officers or military members who have more than six years of service. This is a board hearing where, like a jury, three members of the administrative separation (ADSEP) board vote and determine whether you should be separated or not. The three members board is usually comprised of three senior-ranked members who will hear your side and deliberate evidence for and against you to reach their decision. During the hearing, you can have legal representation, provide witnesses, and challenge board members.

An administrative discharge can have significant implications when it comes to your future employment opportunities, eligibility for benefits, and military social standing. This is why it’s important to have the best legal representation available to put up the best possible defense.

These rights include:

  • The right to appear in person before the board, with or without counsel
  • The right to challenge any voting member of the board for cause; that is, by showing that the member cannot render a fair and impartial decision
  • The right to submit an oral or written statement on your own behalf. You also have the right to testify on your own behalf, or you can remain silent
  • The right to request the attendance of witnesses at the hearing
  • The right to submit any answers, depositions, sworn or unsworn statements, affidavits, certificates, or stipulations
  • The right to question any witness appearing before the board, or have counsel question the witnesses on your behalf.
